Terms and Conditions

The following are the terms and conditions upon which Tamm Driver Coaching (TDC) offer driving lessons and courses to you (the learner).

1. General conduct Your instructor will be polite, tidy and punctual and will keep you informed of any delay on their arrival by text message. A professional and friendly manner will be always maintained, and your instructor will never use improper language or suggestive behaviour and/or physical contact. Your instructor will never shout at you. TDC provide a fully smoke free environment, and we would ask you to refrain from smoking immediately prior to entering the tuition vehicle for the comfort of your instructor and other learners.

2. The vehicle All TDC tuition vehicles are fitted with dual controls. Your tuition vehicle will be well maintained, fully insured for the purposes of providing driver training and meet the legal requirements for road tax and MOT where necessary. Your tuition vehicle will be clean and tidy (weather permitting).

3. Qualifications Your instructor is legally authorised to give driving tuition in the UK by the Driver and Vehicle Standards Agency (DVSA).

4. Legal requirements. As required by law, you must hold a current, valid driving licence (provisional or full), which must be produced on, or in advance of, your first driving lesson, in conjunction with a valid licence check code. You must, before assuming control of the tuition vehicle, demonstrate to your instructor that you can read a number plate at the required distance. You may use prescribed corrective lenses to achieve this if normally worn. Please note: if you require corrective lenses to achieve this, you must wear them on every driving lesson. It is your responsibility to make your instructor aware of any medication you are taking which might affect your ability to drive before the lesson commences.

5. Safety, Comfort and Wellbeing In the interests of comfort and safety you are required to wear suitable footwear and clothing. You are required to always act responsibly, your undivided attention to the driving lesson is a must. If anything is distracting you, it is important you make your instructor aware of this. If you are feeling at all uncomfortable or uneasy during the lesson, please let your instructor know. In an emergency it is important to follow the instructions given to you. You must allow your instructor to take control of the steering wheel if necessary to avoid an incident. Your instructor may also make use of the dual controls, and as soon as it is safe to do so they will advise you of why this was necessary. Your instructor will deliver any instructions or take any actions (even in an emergency) in a calm and measured manner. You must also inform them of anything you feel might impact on your ability to undertake your driving lesson safely. In the event it becomes apparent you are unable to concentrate due to illness, tiredness, or your emotional state of mind, TDC reserve the right to terminate the lesson early.

6. Driving Under the Influence TDC reserve the right to cancel any lesson if you are, or if your instructor suspects you are, under the influence of drugs, legal highs and/or alcohol (prescribed or otherwise). This will result in the forfeit of that lesson time and fee.

7. Lesson Cancellation and Postponement TDC require 48 hours’ notice of a lesson cancellation or postponement by you the learner. Failure to provide the required notice will result in the forfeit of that lesson time and fee. TDC reserve the right to postpone lessons if the weather or road conditions are deemed to be unsuitable or dangerous, or if there are any mechanical failures. In these circumstances, your lesson fee will be carried forward to the rescheduled lesson.

8. Learner Punctuality Your instructor will wait on your arrival for 15 minutes after the lesson commencement time before abandoning the lesson. A “no show” will result in the forfeit of that lesson time and fee.

9. Payment You are required to make payment for pay as you go driving lessons in full and in advance at the time of booking. If booking a course, a deposit equivalent to a two-hour lesson plus the driving test fee will secure a start date. The remaining course fee is to be paid in full and in advance of the course commencement date. Deposits, lesson bookings or lesson balances will be refunded at a rate of 50% if you choose not to proceed with lessons once the booking is made and added to the instructor diary, so long as the cancellation notice period is sufficient. This does not in any way affect your statutory rights to be provided with the goods and services you have bought (please see term 13).

10. The Driving Test TDC will make and manage all practical driving test bookings. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed allowing for someone else's driving test. In the interests of safety TDC reserve the right to withhold the use of the tuition vehicle for use on test if, in your instructor's opinion, your driving has yet to reach the required standard to pass the practical test or if something in your demonstrated behaviour would likely result in a test failure. The practical driving test can be cancelled or amended up to three full working days before the test date, otherwise the driving test fee will be forfeited. TDC cannot be held responsible for any postponement or cancellation of tests by the DVSA. TDC will assist in securing another test as quickly as possible for you.

11. Pricing TDC reserves the right to change lesson/course prices without notice.

12. Complaints In the event you are unsatisfied with any service received, please submit your complaint in writing to Info@tammdrivercoaching.co.uk

13. Your Statutory Rights Nothing in these terms and conditions will reduce your statutory rights relating to faulty goods or services provided. TDC have a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights, please contact your local Trading Standards Department or Citizen's Advice Bureau.
